Conditions of use

The terms and conditions specified hereinafter regulate access to, and the use of the web portal.

The term 'Web portal' comprises but is not limited to - texts, graphics, pictures, animations, musical creations, videos, sounds, drawings, photographs, software, databases, HTML code and other works included therein, and generally all creations expressed by tangible or intangible means or formats, whether currently known or potentially generated in the future, regardless of whether these are subject to copyright according to the restated text of the Spanish Copyright Act or any regulation that might replace it in the future.

 

The Web portal is aimed at Spanish citizens and residents on Spanish territory who are legally of age (or emancipated minors); registration is not permitted for persons in any other situation. LAE urges non-emancipated minors not to request permission to register on the service.

 

The condition of Participant is acquired my means of the registration process outlined on the web portal. Participants need to sign in to guarantee the security of the process and, above all, that prizes are paid out to those who have won them. Access to the web portal as a visitor does not require the registration of personal data, except for an e-mail address in the case of those who would like to be sent information periodically.

 

Participants are aware that the use of, and access to the services and contents of the web portal is their sole and exclusive responsibility.

 

The present conditions of use are fully accepted by the participant by the mere fact of accessing the website and/or viewing its contents or using the services contained in the website . If the Participant declines to accept these general conditions or, where appropriate, the Special Conditions governing the use of a particular service and/or content, the user should abstain from accessing the Web portal and, if applicable, the relevant service and/or content.

 

As a general rule, the services and contents offered via the website will be displayed both in Castilian and the other regional languages, that is, Basque, Catalan, Valencian and Galician. In the event that there are any inconsistencies between the conditions of use of the website and the rest of the legal texts, the Spanish version prevails.

 

The cost of telephone access, or another type of expenditure incurred to connect to the web portal shall be charged exclusively to the Participant.

 

The Participant shall have to implement the appropriate technical security measures to prevent unwanted activities in relation to his/her information system, files and the computer equipment used to access the Internet and, especially, the web portal.

 

 

1. USER RIGHTS AND OBLIGATIONS

 

The participant shall be able to:

 

• Access the contents and services available on the web portal free of charge and without the need for prior authorisation, without prejudice to the technical or special conditions or the need for prior registration with regard to specific services and contents, as specified under these conditions.

• Use the services and contents available for their own private use, without prejudice to the terms set forth in the special conditions that govern the use of a particular service and/or content.

• Make proper and lawful use of the Site, in accordance with current legislation, morals, good customs and public order.

 

Under no circumstances shall the user be able to:

 

• Access or use the Site's contents and services for unlawful purposes, that violate the rights and freedom of third parties, or that may harm, damage or impede access thereto in any way, to the detriment of LAE or third-parties.

• Use the services, whether in part or in full, to promote, sell, hire, advertise or divulge own or third party information without the prior authorisation of LAE .

• Include hyperlinks to this Site on their private or commercial websites in breach of the conditions laid down to this effect.

• Use the services and contents offered through the Site in a manner contrary to the conditions governing the use of a particular service and/or content, and to the detriment of, or prejudice to the rights of other participants.

• Take any action that impedes or hinders access to the Site by participants, or create hyperlinks to the services and contents offered by LAE or by third parties via the Site.

• Use the Site as a gateway to the Internet to commit illegal acts or any that are contrary to current legislation, morals, good customs and public order.

• Employ any kind of computer virus, code, software, computer programme, hardware or telecommunication equipment that might damage or alter the contents, programmes or systems accessible through the services and contents provided on the Website or in the information systems, files and computers of its users, or unauthorised access to any content and/or services of the Site .

• Delete or modify in any way the protective and identification devices of LAE or its rightful owners that might contain the contents hosted on the Site, or the symbols that LAE or legitimate third party holders might incorporate into their creations, subject to existing intellectual property on this Site.

• Include 'metatags' on websites they own or are in charge of for trademarks, trade names or logos owned by LAE or third-parties.

• Reproduce the Site in part or in full on another site or web page without fulfilling the conditions laid down to this effect .

• Create frames to this Site or to web pages accessible through it that might hide or modify-by way of example but not limited to - contents, advertising spaces and brands of LAE or third-parties, regardless of whether or not these constitute acts of unfair competition or confusion.

• Create frames within a website of their responsibility or property that reproduce the home page and/or pages accessible via said home page, included in the Site, without the prior permission of LAE

 

2. RIGHTS OF LAE

 

LAE reserves the following rights:

 

• To modify the conditions of access to the Website, technical or otherwise, unilaterally and without notice to the participants, without prejudice to the terms set forth in the specific conditions governing the use of a particular services and/or content of the Portal.

• To establish special conditions and, where applicable, the requirement of a price or other requirements to access certain services and/or contents.

• To limit, exclude or restrict access to users when these fail to provide a full guarantee of the proper use of the Site, in accordance with the obligations and prohibitions they agreed to.

• To set limitations to the number and amounts of bets, Lotobolsa top-ups and Lotobolsa fund retrievals for each participant.

• To terminate the provision of a service or the supply of a content, without a right to compensation, when unlawful or contrary to the applicable conditions set forth, without prejudice to the special conditions governing the use of a particular service and/or content of the Website.

• To undertake any legal or judicial action deemed appropriate to protect the rights of LAE and those of third parties providing their services or content through the portal, whenever appropriate .

• To demand compensation for costs that might arise due to the improper or illegal use of all or part of the services and contents provided through the Site.

 

3.    EXEMPTION AND LIMITATION OF LIABILITY ON THE PART OF LAE

 

LAE is exempt from any liability for losses or damages, whatever their nature, that may derive from the following situations:

 

• Due to connection problems or the impossibility to connect to the communication network that enables access to this web portal, regardless of the kind of connection used by the user.

• Due to the interruption, suspension or cancellation of access to the web portal, the availability and continuity of the operation of the web portal or the services and/or contents contained therein when these are due to a cause beyond the control of LAE and/or STL, whether directly or indirectly derived from it.

• LAE assumes no responsibility whatsoever with respect to services and contents, or the availability and conditions, technical or not, of access to these services and contents, when provided by third party service providers, with special emphasis on service providers from the information community.

• LAE shall never assume any responsibility for losses or damages that might be caused by - by way of example but in no way limited to-the following: information, contents, products and services lent, shared, hosted, transmitted, exhibited or offered by third parties unrelated to LAE. -including service providers from the information society- via a web portal that can be accessed via a link displayed within this web portal .

• The handling and subsequent use of personal data by third parties unrelated to LAE, and the pertinence of the information requested by these .

• The quality and speed of access to the web portal and the technical conditions the user must meet in order to be able to access the portal and its services and/or contents .

• LAE shall not be held responsible for any delays or faults that might occur during access to and/or the operation of the services and/or contents of the portal arising due to a case of Force Majeure .

• The participant shall be personally liable for losses and damages, whatever their nature, caused to LAE, whether directly or indirectly, due to the failure to fulfil any of the obligations derived from these general terms and conditions or any other regulations that govern the use of this web portal .

 

4. GOOGLE ANALYTICS

All copyrights and economic exploitation rights over the contents included on the web portal are the property of LAE or where applicable, of third parties; in both cases, these are protected by current copyright laws.

 

The brands, trade names or distinctive signs that appear on the web portal are owned by LAE and/or STL, and protected by current industrial property laws.

 

The provision of services and the publication of contents via the web portal shall under no circumstances entail the cession, renouncement or transfer, whether total or partial, of the ownership of the relevant intellectual and industrial property rights.

 

No part of this web portal may be reproduced, distributed, transmitted, copied, publicly shared or transformed, whether in part or in full, by any manual, electronic or mechanical systems or means (including photocopying, recording or any information recovery or storage system) in any format currently known or invented in the future, without the prior consent of LAE and/or STL. Under no circumstances may users make any use of the services and contents on this web portal for any purpose other than their exlusive personal use, except for the exceptions specified in the present conditions of use of this web portal or in the special conditions that LAE and/or STL may wish to establish to regulate the use of a particular service and/or content provided via the web portal.

 

If the activity, or culpable or negligent omission directly or indirectly imputable to the Participant of the web portal, causing the violation of the intellectual and industrial property rights of LAE or third-parties - whether or not s/he profits from it - causes LAE to incur any damages, losses, joint obligations, expenses of any nature, sanctions, coercive measures, fines and any other costs arising as a result of, or deriving from any claim, demand, action, lawsuit or procedure, whether civil, criminal or administrative, LAE shall be entitled to bring proceedings against the user by any legal means at its disposal and to demand any compensatory amounts, including but not limited to, moral or image-related damages, consequential damage and loss of income, advertising costs or costs of any other kind that might be incurred for repairs, amounts for sanctions or convictions, late payment interests, the cost of funding both quantities potentially incurred by the opposing party, legal costs and the amount of the defense in any process in which it might be sued due to the above-mentioned causes, for damages or losses incurred due to its own actions or omission, without prejudice to exercising any other activities it is entitled to by Law .

 

6. HYPERLINKS

 

Persons or entities wishing to create or creating a hyperlink from a webpage belonging to any other Internet portal to any of the pages of the LAE web portal will be subject to the following conditions:

 

• The partial or total reproduction of any of the services or contents of the web portal is strictly prohibited.

• It is forbidden to establish any deep-links, IMG or image links or frames to or with the pages of the web portal without the express prior authorisation of LAE

• No false, inaccurate or incorrect statements regarding the pages of the web portal or its services and contents shall be included.

• Except for those signs that form part of the ""hyperlink"", the website to which it is added shall not contain any brand, trading name, establishment name, denomination, logo, slogan or any other distinctive signs belonging to LAE, unless expressly authorised to do so by LAE.

• The addition of the ""hyperlink"" shall not entail the existence of any kind of relationship between LAE and the holder of the website or portal from which it is added..

• LAE shall not be held responsible for the services or contents made available to the public on the website or portal from which the ""hyperlink"" is created, or for any information and statements included therein .

• Any ""hyperlink"" to the LAE web portal shall be to its home page or the main pages of the sections therein contained.

 

7. LINKS

 

LAE rechaza cualquier responsabilidad sobre la información contenida en páginas web de terceros conectadas por enlaces con el Portal de LAE or not managed directly by our web portal administrator.

 

The links that appear on this web portal are for informative purposes only and shall under no circumstances constitute a suggestion, invitation or recommendation to visit these destinations.

 

In the event that in order to use some of the services of the web portal, participants find themselves obliged to previously provide LAE with certain personal data, LAE shall handle said data for the purposes and under the conditions specified in its Privacy policy.

 

8. DURATION AND TERMINATION

 

In principle, the duration of the provision of the web portal service and other services is indefinite. LAE however has the right to terminate or suspend the provision of the web portal service and/or any other service, at any time, without prejudice to that which may have been set forth on the subject in the relevant Special Conditions. If reasonably achievable, LAE shall provide advance notice regarding the termination or suspension of the provision of web portal services and other services

 

9. NULLITY AND VOIDABILITY

 

In the event that any clause of these general terms and conditions or, where applicable, special conditions regulating the use of a certain service and/or content become null and void, whether in part or in full, this nullity or voidability shall not affect the validity of other clauses thereof, which shall remain fully effective and valid, insofar that the party alleging its nullity of voidabilty can provide proof that without the nullified or avoided clause, the purposes of the present Conditions cannot be fulfilled .

 

10. APPLICABLE LAW AND JURISDICTION

 

The present general conditions shall be governed by the Spanish law. The parties, expressly waiving their own jurisdiction, submit themselves for the settlement of any proceedings that may arise to the Courts and Tribunals of Madrid Capital.
