MODEL FOR THE DETECTION OF INTENSIVE AND RISKY GAMBLING BEHAVIOUR
In accordance with the provisions of Royal Decree 176/2023, of 14 March, which develops safer gaming environments, two models for the detection of players with problematic gaming behaviour are established. For the first model, intensive gambling behaviour, the RD establishes the requirements to be fulfilled and the second model, risk behaviour, is established by SELAE.
Participants with INTENSIVE GAMBLING behaviour
Detection model:
A participant is considered an intensive participant if he/she has incurred weekly net losses of 600 euros or more if he/she is over 25 years of age or 200 euros per week if he/she is 25 years of age or younger, for three consecutive weeks.
The weekly net loss will be calculated on the basis of the initial balance that the participant had in his/her account (Lotobolsa) at the beginning of the week taken as a reference plus the loads made and prizes won throughout the week, minus the bet purchases, withdrawals from his/her account and the final balance at the end of the week.
For the calculation of the week: the week between 12:00 pm on Monday and 12:00 am on Sunday.
Limitations:
Participants with intensive gambling behaviour shall not be able to deposit funds using credit or debit cards. This measure shall be activated within the first 72 hours corresponding to the week following the week in which these participants have acquired the status of participants with intensive gambling behaviour.
Loss of intensive gambler status
Participants shall lose their status as players with intensive gambling behaviour when six consecutive weeks have elapsed without, in any of them, exceeding the weekly loss levels indicated above.
Comunications with the player with intensive behaviour
When a participant is detected to be engaging in intensive gambling behaviour, he/she shall be notified of this status and shall be provided with the information set out in RD 176/2023.
Likewise, the participant during the time in which he/she meets the condition of intensive player, will receive a monthly summary of activity provided for in article 18 of RD 176/2023. This summary of activity will be received within the first five days corresponding to the month following the month in which the participant has acquired the condition of intensive behaviour. This monthly summary shall be maintained at least until the month following the month in which the participant no longer meets this condition.
When the participant loses the status of intensively behaving participant, he/she will receive an e-mail indicating this and the removal of all the above-mentioned limitations.
Participants with RISKY GAMBLING behaviour
Detection model:
A participant with risky gambling behaviour is a participant who, having been classified as an intensive participant, has incurred a net weekly loss equal to or greater than 600 euros for participants over 25 years of age or 200 euros for participants under or equal to 25 years of age in any of the following 6 weeks after being classified as an intensive participant.
For the calculation of the week: the week between 12:00 pm on Monday and 12:00 am on Sunday.
The calculation of the weekly net loss is the same as indicated above for intensive gambling behaviour.
Player limitations:
Account suspension
A person who has been categorised as a participant with risky gambling behaviour will have their gaming account temporarily suspended, which will prevent them from playing for 12 weeks.
Restrictions on commercial communications
A person who has been categorised as a participant with risky gambling behaviour will NOT receive commercial communications by email or other equivalent means of communication, including commercial communications about promotional activities.
Limitations on means of payment
Participants engaging in risky gambling behaviour shall not be allowed to deposit funds by any of the established means of payment.
Loss of at-risk player status
Participants shall lose their status as players with risky gambling behaviour twelve weeks after their detection.
Communications with the player with risk behaviour
When a participant is detected as engaging in risky gambling behaviour, he/she shall be notified by mail of this status, indicating that his/her account has been suspended, which prevents him/her from participating in gambling activities. They shall also be provided with the information set out in RD 176/2023.
The person classified as engaging in risky behaviour may file the corresponding complaint or claim against such classification under the terms provided for in section 1.c) and 3 of article 15 of Law 13/2011, of 27 May in : Contact - Loterías y Apuestas del Estado (loteriasyapuestas.es)
When the participant loses the status of risky gambling behaviour, he/she will receive an e-mail indicating this and the removal of all the above-mentioned limitations.
