Detection of Risky Gambling Behavior

Model for detecting intensive and risky gambling behavior patterns

In accordance with Royal Decree 176/2023, of March 14, aimed at developing safer gambling environments, two models are established for detecting participants with problematic behaviors:

  • Intensive Gambling Behavior (as defined by Royal Decree 176/2023).
  • Risky Behavior (as defined by SELAE).
 

Participants with an INTENSIVE GAMBLING behavior pattern

Detection model:

A participant with an intensive gambling behavior pattern is one who records, over three consecutive weeks, net weekly losses equal to or greater than:

  • €600 per week if over 25 years of age
  • €200 per week if the participant is 25 years old or younger

Calculation of net weekly loss:

The calculation starts from the initial balance in the account (Lotobolsa) at the beginning of the week (00:00 Monday), plus deposits made and prizes won during the week, minus bets placed, withdrawals, and the final balance at the end of the week (24:00 Sunday).

Applicable limitations:

Participants identified with intensive gambling behavior are prohibited from depositing funds via bank cards (credit/debit). This restriction will be applied within a maximum of 72 hours after the week in which detection occurred.

Loss of intensive player status

This status will be lost once six consecutive weeks have passed without exceeding the indicated weekly loss limit in any of them.

Communications to the participant with intensive behavior

Once this condition is detected, the participant will be notified in accordance with Article 19 of RD 176/2023, including detailed information about their status. While maintaining the intensive player condition, they will receive a monthly summary of their gambling activity within the first five days of the following month. This monthly report will be sent at least until the month after the condition is lost.

When the participant is no longer classified as an intensive player, they will receive an email informing them of the change and the removal of the applied restrictions.


Participants with a RISKY GAMBLING behavior pattern


Detection model:

A participant with a risky gambling behavior pattern is one who, having previously been classified as intensive, incurs in any of the six weeks following this initial classification a net weekly loss equal to or greater than:

  • €600 if over 25 years of age
  • €200 if 25 years old or younger

Calculation of net weekly loss:

The calculation of net weekly loss is identical to that described in the intensive gambling model.

Restrictions for participants with risky behavior:

  • Account suspension:

    Temporary suspension of the gambling account for 12 weeks during which participation will not be allowed.

  • Restrictions on commercial communications:

    They will NOT receive promotions or commercial communications by any means.

  • Total prohibition on depositing funds through any authorized payment method.

Loss of risky player status

This risky player status will be automatically lost after twelve weeks have passed since the communication of this classification.

Communications to the participant with risky behavior

When a participant is detected as having risky behavior, they will be notified by email, informing them of the suspension of their account and all information established in RD 176/2023.

They will also be informed of the possibility to file complaints or claims in accordance with the terms set out in sections 1.c) and 3 of Article 15 of Law 13/2011, of May 27, available at Contact - Loterías y Apuestas del Estado (loteriasyapuestas.es)

When the participant no longer holds this status, they will also receive an email notifying them of the removal of all previously mentioned restrictions.
